These Terms and Conditions ("Terms") govern your access and use of the My Tax Digital web application ("the App"), which is provided by Open Answers ("we", "us", or "our"). By registering for or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.


1. Disclaimer and Service Provision

  1. Purpose: The App is a free software tool designed to help UK sole traders, landlords, and businesses comply with HMRC's Making Tax Digital (MTD) for VAT and MTD for Income Tax Self Assessment (ITSA) regulations.
  2. "As Is" Basis: The App and any materials related to it are provided "as is" and without any representation or endorsement or warranty of any kind, whether express or implied.
  3. No Warranty: We do not warrant that the functions contained in the App will be uninterrupted or error-free, that defects will be corrected, or that the App or the servers that make it available are free of viruses.
  4. No Tax or Legal Advice: The App, including the AIsha assistant, provides automated guidance and technical support for using the software. We do not provide professional tax, accounting, or legal advice. You should always consult a qualified professional for advice specific to your financial situation.

2. Using Our Web Application

  1. Acceptance: Your access and use of the App constitute your acceptance of these Terms, effective from the date you first use the App.
  2. Lawful Use: You agree to use this site only for lawful purposes, and in a manner that does not restrict or inhibit the use and enjoyment of this site by any third party. This includes, without limitation, the transmission of offensive content or disruption to the normal flow of dialogue within the site.
  3. Terms Revisions: We may at any time revise these Terms without notice, and therefore they should be checked regularly. Your continued use of the site after a change has been made constitutes your acceptance of the change.
  4. Information Use: Information collected is used for internal review, to improve or customise the content and layout of the site, and to provide information services to the App users. It is not shared with other organisations for commercial purposes.

3. Registration and Accounts

  1. Age Requirement: You must be at least 16 years old to register for an account.
  2. Registration Process: You may register by completing and submitting the account registration form and clicking on the verification link in the email sent to you.
  3. No Sharing: You must not allow any other person to use your account to access the App unless you have that person's express permission to do so.
  4. Unauthorised Use: You must notify us in writing immediately if you become aware of any unauthorised use of your account.

4. User Login Details

  1. Confidentiality: If you register for an account, you will be asked to provide an email address and password. You must keep your password confidential.
  2. Responsibility: You are responsible for any activity on the App arising out of any failure to keep your password confidential and may be held liable for any losses arising out of such a failure.
  3. Account Security: Our primary responsibility is to keep account information secure, safe, and private. If you have lost access to the email address on your account and do not know the password, then for security reasons we cannot help you regain access to that account. We cannot provide passwords or other login details.

5. Cancellation and Suspension of Account

  1. Suspension/Cancellation by Us: We may suspend or cancel your account, and/or edit your account details at any time in our sole discretion, with or without notice to you. We will usually cancel an account if it remains unused for a continuous period of 7 years.
  2. Deletion by You: You may delete your account using your account control panel within the App. Data cannot be recovered following the deletion of your account.

6. Linking to Our Web Application

  1. Permission Required: You must ask our permission to link directly to pages hosted on this site.
  2. No Framing: We do not permit our pages to be loaded into frames on your site. Our pages must load into the user's entire window.

7. Virus Protection

  1. Our Efforts: We make all reasonable attempts to check and test material at all stages of production and to exclude viruses from this App.
  2. Your Responsibility: It is always wise for you to run an up-to-date anti-virus program on all material downloaded from the Internet. We cannot accept any responsibility for any loss, disruption, or damage to your data or your computer system which may occur whilst using material derived from our App.

8. Privacy Policy

  1. Acceptance: Your use of this site constitutes acceptance of our Privacy Policy.

  2. Financial Liability: In particular, we will not be liable for any fines, penalties, interest, or liabilities imposed by HMRC due to errors, late submissions, or inaccuracies arising from your use of the App or your reliance on the information contained within it.
  3. Exclusions: Nothing in these Terms limits our liability for death, personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by English law.

10. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising under these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
